to get the achievements do i need to use the drums or can i use just the guitar or my paddle

any drum related achievements will require you to play the rock band drumkit

Yes, you have to play on drums. You can use RB1/RB2 drums, or (once they are released) the GHWT and/or Rock Revolution drums.

but which achievements are you referring to? yes, you have to use the drums for the beat/fill trainer achievements (obviously), and again, obviously it's necessary for the 100% expert achievement

the only drum achievement that doesn't require you to use the drums is the "AN-I-MAL!" achievement. just get a friend who's unlocked that challenge to play it with you. you can play guitar and still get it.

just like in guitar hero i could use a controler to play if i dont have a guitar could i do the same with the controller

No, that's what they've been telling you. You must use a guitar controller for ALL guitar parts. You must use a drum controller for ALL drum parts. RB does not allow you to use a standard controller except to navigate menus while you are using the microphone.

I got the drum achievements on RB1 just by hitting my head against the wall. I'd recommend you giving that a go.
