Currently, when you purchase an item, you can resell the item, give it away, or use it in pretty much any way you see fit. However, there are companies that are trying to take those rights away – and now is the time to defend those rights. Here’s the scoop:

Certain copyright holders are trying to use copyright law to stop sellers from listing goods without their permission. These companies are trying to use the courts and Congress to erode traditional protective doctrines that protect your right to resale. These rights are known as first sale or ownership rights.

What’s happening now?
An upcoming Supreme Court case, Wiley v. Kirsteang, involves an eBay seller who was sued by a textbook publisher for reselling books manufactured overseas. Kirsteang, the seller, was a student who sold the books to help cover his tuition expenses. The publisher is trying to use U.S. copyright law to stop the defendant from selling the textbooks and to have him pay $600,000 in damages.

Why does this affect me?
If these companies succeed in the courts in eliminating your first sale or ownership rights, sellers may have a harder time accessing inventory and selling goods. Buyers may have fewer places to purchase items.

What can I do?
Citizens for Ownership Rights, a coalition of public interest organizations, is currently organizing a petition to demand that the Administration support the notion that when Americans purchase legitimate goods, they should be assured that the goods can be resold, given away, and used in any manner they see fit.
