So reading these posts, I can't have something violent in my emblem, like a fist punching some animal?

 

So if I have my hammer about to crush a rabbit as my emblem, I will get banned? I have that as my emblem right now, so... :|

I only think you will get in trouble/banned if you have something like a penis/extremely inappropriate in a sense. I wouldn't worry about yours at all.

Well, this is a 17+ game; technically pornography (and yes, some emblems I've seen are considered as such) is only permitted to 18+. I personally don't have a big issue with it, I find some of it pretty funny.

 

Although the ESRB doesn't rate online play...so take my comment with a grain of salt. I have no idea how that's handled. :confused:

NO!!!!! Here is a link to the XBL Code of conduct http://www.xbox.com/en-US/legal/codeofconduct (credit to Tieg). Also here is an excerpt involving this type of concern.

 

Don't create a gamertag, profile content, Avatar action, Avatar content, or ingame content that other users may be offended by. This includes, without limitation, anything related to or suggestive of: profane words/phrases, topics or content of a sexual nature, hate speech (including but not limited to racial, ethnic, or religious slurs), illegal drugs/controlled substances, or illegal activities.

TC is talking about things other than the swastika, like anything that can be deemed innapropriate. Example being an emblem where animals are humping. That would get you banned.

everybody, this is a much easier topic to understand that what we are making it out to be. It all comes down to the terms and conditions of XBL. Anything deemed offensive can be grounds for a warning, temp ban, or perma ban, depending how serious the offense is and probable whether or not is a repeat offnse. The language in the T&C for XBL are so broad that nearly anything can be deemed offensive. Basically when you agree to the T&C you are handing over all your XBL rights to microsoft. Just because you and a million other people find something fun, and NOT offensive, doesnt mean you cant be banned for it. I think the horse humping the gorilla is hilarious, but you can still be banned for it.

LOL...no one ever reads the T&C of xbox live...

 

But we have to understand we own NOTHING on live. You pay to use the service but M$ owns the rights to it all and makes the rules...odds are if it seems wrong then you could get banned for it.

But in the realms of reality, both are right, but very vague. ANYTHING can be offensive to anyone at any time. If someone had a gamertag that said "HitlerWasRight", I'd laugh and not care. But I get offended when I see stupid gamertags like "xXL33tn00bKiLLaXx".

 

Terms like that are just vague "saving their asses" policies so if some random person complains about something, they can just step in and remove the "problem", instead of telling the complainer to "deal with it". MS implemented the "rep" system so you can rep to play with or never see again. If you're offended by a gamertag or emblem of someone, take it on yourself to block the offender and move on.
