Gears of War 3 Was 2011's Most Pirated Xbox 360 Game

Gears of War 3 was 2011's most pirated Xbox 360 game, according to TorrentFreak. As detailed in the site's round-up of most pirated media, Epic's meaty shooter threequel amassed a total of 890,000 (totally illegal) downloads.

Despite an early build of the game leaking onto the net this summer, it would seem that these downloads came from later, retail code. Interestingly, according to the stats the Xbox 360 suffers from a little less piracy than the Wii (Super Mario Galaxy 2 was downloaded well over a million times), while PS3 piracy is so low that TorrentFreak don't even deem it necessary to calculate the figures.

Meanwhile, PC games average more than three times the piracy levels of their console counterparts.

The figures for the torrent charts are estimated, with data mined from "several sources, including reports from all public BitTorrent trackers," according to TorrentFreak.

It's probably a good time to point out that downloading and using torrented game code on modded Xbox 360's is something that Microsoft do not like. Do it and you're likely to get a ban and a Bill Gates goon on your doorstep with a baseball bat.

This is a shame. I've been on the fence about even dropping bill on the weapon skins pack just to support EPIC because they've been a favorite dev of mine since early Unreal Tournament games and they truly delivered the best GOW experience they could have possibly produced, imo.

Ok what about the newgroups, thats another few hundred of thousand at least probably way more.. But its all balls anyway, epic and activision are making a bloody fortune anyway. Perhaps they should stop blaming the pre-owned market for forcing increased retail prices and jsut cut the gamer some slack.

This xmas should be a leason learnt for all publishers, drop your prices permanently and maybe we can all get along better.

Even if so many copies have been downloaded illegally, it doesn't mean that every single user would have bought the particular game.

Of course, I do NOT support the idea of keeping that pirated game if you really loved it. Instead, one should buy it and support the developer if he/she is into that game :-)

Gears is a game I would buy, I want to see Epic create another one, it's one of my all time fav series besides Uncharted for my PS3 and the COD Modern Warfare series.

What a shame.

Here in Brazil we got a long history of games piracy.
It's because of the ridiculous importation taxes we got here.
For example, Battlefield 3 costs about 55 USD , if you convert to BRL it would be about 105 BRL. But plus taxes and a *really* small profit for the retailer, it is costs about 280 BRL for us. More than the double.

In the end on last year MS started fabricating Xboxes and Games here in Brazil, and the prices have considerably dropped.
GOW3 was the first "game with national price", and it costed me 139 BRL in the pre-sale (about 74 USD), wich was a very nice price for brazilian standards.

Nothing justifies piracy in this case.

I HATE SOFTWARE PIRATES; Do you pay for the food you eat? How about your electricity bill, mortgage/rent, phone bill? Or do you STEAL all that too? F***in' pay for your games, trade-in for them or wait till there on sale. I got Gears 3 for $20 the day it came out by tradeing in 2 games I was done with. I got Batman AC for $12 the day it came out because I pre-ordered it at Best Buy and got 60% extra credit on RAGE trade-in (got $48 credit for that ONE game). Just pay attention to store specials and you can get great new games HONESTLY. "Bunch of savages in this town."

Piracy is a little too lucrative though, it costs 30 quid to mod your console from my friends dad & most people & 5 pound for games that means if you get a year out of the console b4 you get banned & get 50 games your looking at well over 1,000 pounds worth of games for 300 quid then the next year pay 60 quid for a new console & do it again. so paying to do it every year is beneficial, Piracy is a problem because its too easy

Just want to point out i do not have my console modded in any way shape or form lol i make a bit of money & Xbox & my gamerscore are a very large part of my hobbies & i wouldn't do anything to jepordise losing any of it. Too scared too do it because i don't wanna loose my gamerscore, sounds sadder typing it for some reason lol

Can i also just say supporting the developer is NOT an argument. What percentage of the xbox gaming collective actually cares about the developer ? i'm guessing a very small number. When people say that to me i go Pfft, bugger off as do most people. I buy my games legit for 2 reasons, so i wont get banned & be without my xbox & gamertag & because people who pirate things like that are cunts, i understand movies you get 90 mins of playtime for 10 pounds which sucks, for 40 quid on some games (skyrim) you get 100 hours. Worth it, dont be a cheeky prick & not pay 40 quid for 100 hours. Simple

It's a good thing that downloading in Canada is not illegal, so this doesn't really affect anything up here.

Also, the fact that Microsoft thinks they can accurately track something like this is both laughable and ludicrous. How do they know that 400,000 people just didn't have to download it twice? Or what about people who downloaded it three times? All kinds of file errors are possible, not to mention bad torrents.

I don't own a modded X-box 360 personally, so that should stop most angry rebuttals in their tracks right there. Retailers shouldn't mark up software so much, more people would buy things if they were more accurately priced. (Just because a game is new, does not mean that it requires a $59.99 price tag.)

Congrats to every person who got a pirated copy of Gears.

@46, I actually do care about developers, and, especially more recently, a developer or producer's name on the game has begun to have a bit more sway. I love Remedy, Bungie, and Epic, all great studios whose names at least force me to look into their games. Gotta respect Rockstar, too. My favorite developer was Ensemble; I own every game they made. At the same time, I dislike EA and Activision, and have started to steer away from their titles more often. To me, supporting the developer is a totally valid argument; I think Epic deserves to be paid for their hard work and great game through the purchase of a legitimate copy of Gears 3.

@47 - the majority of gamers on xbox are casual gamers they dont know many devs besides infinity ward, they dont care about them, why should they. They make games we give them money that should be the end of it, we're not going to buy brand new to support them we have other things to spend our money on, university course fees, alcohol, new cloths.

Yes we should do so, but i have other things to do, i want my games & i want them top quality i'll pay for them. beyond that i don't care, thats the opinion of the masses & thats who shifts the copies of their games & keeps them in business.

When we are then told to care about them we just shrug & go meh, we have better things to do, they'll still be in business there still getting my money, but beyond that i have other things going on

Piracy on the xbox is even easier than PC. All you have to do is to mod your console, burn the game and play. The game on PC cannot be allways cracked (HAWX2 for example). The reason why we download our games is that we aren't willing to pay 60-70€ for a console or 50-60€ for a PC game. There were times when we payed 20-30€ MAX for a game. And they can't even caught you plying online if you are carefull. My brother played online when the banhammer was in progres so I got banned, but my friend is still playing downloaded games on his xbox. And I downloaded all of these games exept Kinect Sports: Season 2

Number 54 is correct, a majority of people just don't care. It may seem like there's a large vocal fanbase that supports the companies...but there's an even larger number of people who don't give a shit. It's like that with any media that gets downloaded via torrents...whether it's a movie or TV show, a majority of folks DO NOT CARE that they are obtaining these things illegally. It's the sad truth, you can have a product available for people to buy new and support a company...but those who just want to play the game will most likely buy it used if it's any bit cheaper than the new copy or if they don't want to pay money at all...they'll download it illegally.

Pretty much anyone who buys regularly used games from Gamestop cares little to nothing about money reaching the developers, they're just trying to get new or older games for cheaper. Not everyone can be expected to care about EPIC or Infinity Ward, or the smaller companies especially.

Piracy is a huge market in my country. As a Brazilian posted, we have the same issue in my country. Consoles cost US$500 (while it costs us$200 in USA) and ALL games cost US$75 (while they cost $60 or lower in USA). Considering the average salary of a single person is around US$800, a game that costs US$75 is quite expensive.

Gaming industry doesn't give a shit about us latin americans (we don't produce consoles, they sell us overpriced consoles and games, we don't have dedicated servers, we don't have game stores like 7/11, gamestop, etc.) so everything about games, of all consoles, are expensive and hard to find, then people find piracy very tempting.

I bought the Gears 3 console and Epic Edition launch night and still have my receipt for both. I'm a huge fan of Epic Games and the content they release. It's people who take it upon themselves to steal someone else's work that ultimately causes consequences for everyone else.

@56 - Why can't everyone be expected to care though? Is it not the morally right thing to do - to pay for your game just like everyone else paid for their game. I don't care if it's Epic or Infinity Ward or whatever other company. They still have employee's who show up to work to provide for their families and as a company, they try and make money so that they can keep doing what they enjoy doing. From the companies standpoint though, why should I keep making games at all if people are just going to steal them and I can't make any money off of it? Imagine if everyone downloaded Gears 2 illegally and thus Gears 3 was never made... Imagine that. Can you imagine missing out on Gears 3 and never getting to experience what a great game it truly is!? I can't!

I think people should be expected to care though. If you can't buy a game, that's understandable - we've all been there. There are times I can't buy games because of bills and other finances but I don't go out and steal something just because I want it... That's an ignorant mindset for anyone to have in my opinion.

I don't agree that people who buy used games don't care about the developers. On the contrary, you may be missing the point entirely. It's not my fault if I can't afford a particular game brand new the day it comes out but that I can a few weeks later when it goes on sale. There's nothing wrong about buying a discounted game, especially now that most have online codes you have to pay more for anyway.

Regardless of what is said though, you'll always have people torrenting and downloading digital goods illegally and that's the real shame of it all.

@62 People can't be expected to do anything, that's why they're human - they have the right to choose what they do. To have faith that everyone will do the right thing...it's admirable but unfortunately that's not the reality. As those numbers prove, a lot of folks will illegally download something so they don't have to pay for it. Whether it's just them being cheap or maybe their financial situation doesn't allow them the ability to purchase brand new games when they come out, it happens. You're right, it is an ignorant mindset for these people...they'd rather do something illegal than save up to get the game they want, it's sad.

I didn't say that people who buy used don't care about the developers...what I meant is that people who buy used can't be "expected" to care about them. You really think a casual gamer is going to come in and give two shits about Nintendo as a company, or Capcom? No, they'll buy used without thinking twice that the developers aren't getting any of the money. Why? Because it's cheaper...I'm not ridiculing people who buy used, I do it too but so many ignorant assholes love to think that buying used is "piracy" and will go on and on about how it's killing developers. Yes, no profit is seen to the developer when it's bought used but that game was "new" at one point...the developer already got their money's worth. Now the argument here is that if there's a used copy and a new copy (thus meaning a potential sale for the developer), that the person should choose the new copy to give even more profit to the developer. But if that person is trying to save money, there's nothing wrong with getting the cheaper copy...EVEN if it's a few bucks cheaper. Though they're be branded like a heathen because of it by the pro-developer community.

I believe you were missing the point of my post by saying I was missing the point of yours...the point of my post is that the number of casual gamers triumph over the number of gamers who care about the developers. While it's admirable to think that "people are good", most people (provided nobody's watching them or telling them it's bad) don't care about the developer. There's no reason to expect this of people either...you get someone at a retail store who asks you if you want to donate $1 to help needy children and most of them will say no. Is it because they are bastards? No, I'm not saying that most people are bastards here...they may not have the additional money to pay for it. Yeah, a buck doesn't seem like much but in this economy it's a lot more than people give it credit for. Same with paying 30 bucks used for a game when it might be 60 new. People don't care not because they're bastards or trying to be cruel...it's because they have their own problems to deal with and they need to save their money.

Look, regardless of all of this...I think the term of someone not caring about something is taken out of context. Hell even me saying someone doesn't give two shits about something might be seen as negative...it's not. If it's cheaper, people will go for it...it's not bad, it's not cruel. Getting something illegally by downloading it is and choosing never to buy the actual game makes it more so. Paying discounted, paying used...it's all fine. A mother wants to get a game for her son, she sees that it's much cheaper to get it at Gamestop...so she does. Can she really be expected to know anything more than the title of the game? A lot of people buy games just because they heard it was fun from a friend...or they want to get it for someone else. Or maybe they're just curious because the cover looks cool and some stuff on the back cover interest them...they're probably not even looking at the company name or thinking about the developer. When I say "they don't care", I mean it's not a thought in their mind. They don't KNOW about the developer...casual gamers usually have no idea that even the video game companies are dealing with crap in the economy. They buy the game to play it and have fun, no matter what the price.

I hope that's clear enough...people can buy used or they can buy new...it's their choice. Just not everyone can be expected to know who even made the game.

After all the problems I've had with Gears 3 (freezing, resetting etc.)and throw in the fact a lot of the DLc is on the disc which really irks me I wish I had downloaded it too.

If you have a job and are comfortable with bills and al that stuff. Games really aren't that expensive, especially all the time put into them. All togather i paid about 300 for the CoD games. But I have about 75 days of my life wasted to them. So they're really not the expensive. The only thing that I can think of that I spend more time wasting away is driving. But are new cars are expensive lol

@66 sounds like your xbox is the problem, not the game. i didn't have a single problem with freezing or anything else. gears of war 3 is a very polished product.

I don't pirate games. I never have and never will. That doesn't mean i'm going to hate on someone who does though. We are all human and have different morals. To some they feel it isn't wrong. For others they would rather have rusty spoons shoved in their eyes! (Exaggeration I suppose...) I do however believe that if you can't afford a game, then you either wait for it to go on sale or look for it online/ used. I don't think buying a game from Gamestop really changes how much a developer will get either. If someone isn't willing to pay $60/ $75 usd for a game the developer wouldn't have made the sell anyway. How can you lose money on something that never would have happened? However, if the person who bought the game used liked it, who is to say that if a sequel was made or another game was developed by the company they wouldn't buy it new from the enjoyment of the game they bought used? Anyway, to finish my small essay, I would just like to say that people will do the things they feel are right. There is no stopping them from doing it.

@68 I haven't played it myself but apparently if your game freezes in an online match and you go straight back into loading the game again after resetting your Xbox, all of your online data will be erased (including progress on Onyx Medals). Because of this, Gears of War 3 isn't THAT polished...the workaround to losing all your Onyx Medals is to go into your Xbox Dashboard and delete the corrupted Player Data file that occurs from an online match glitching out and freezing. It's irritating but to my knowledge this problem is still existent.

In their defense, I have to say I totally understand. Sale figures are up for video games and now more than ever ppl play one way or another. But devs decide to do what? Instead of lowering the price or at the very least keep the prices we are used to, they start coming up with ways to charge us more and more.

How can you blame ppl for trying to get something for free, legally or not, if they can't even afford it? I am not saying problem would disappear if games were cheaper, but it would help a lot. I am still paying for brand new games, sometimes only waiting for the price to go down, but I complained many times over that I don't like direction this whole industry is headed.

Especially if we take MS with their lousy deals and promotions and trying to "steal" as much money from us as possible. So, people decide to "steal" some of that money back from them, I don't see a problem with that, though you would never find me doing it, unless I had a good reason (like being out of job).

@#63 Nothing to LOL at - PS3 has a great customer service and players really feel like they are taken care of, especially with deals and updates. It might not be perfect system, but last year definitely belonged to Sony when it comes to games, even when considering their big hack and that is saying a lot.... While MS keeps rolling out media no too many care about or use...

Terrible news, the company's must be losing millions, to be fair I would say half the people wouldn't have bought the games anyway but seeming they can get them for free why not downloaded it & give it a whirl.

They must do more to stop this, even though I do download movies from these type of sites but never games.

If i was walking down the street And i saw £40 on the floor I would pick it up & keep it so you can't blame people for downloading them, it's no different really.

I love how they can track how many people pirate games and yet can't seem to take any real legal action. Sounds like a bs number that's been made up by Microsoft. By the way, they sold like 8 million kinects, so there is a big market out there. Most people on this site bash kinect, but forget that the achievement community makes up a tiny portion of the people that buy and play games. We are the minority among gamers.

Of course the Pirating on the PC is going to be more, its simple download, install, and crack. On the 360 there is a whole lot more involved (not that I would know) and less people are likely to do it because they have accounts that they worked alot on.

I think people downloading things illegally is disgusting, music, film and game wise. If you were working hard on doing these things then you'd
be pissed that people are doing it for free and taking away your money!
Needs to be clamped down more, think long sentences and BIG fines should be
issued only then will the problem stop!

@38 who would buy a pirate game if prices were as low as a fiver? Just can't see it myself it would probably cost you that for a fake one! Anyway i sometimes wonder if big game developers leak these out on purpose to the black Market, it's kind of like setting off the loss margin with the cost of the free advertising. If that's not the case then you have some really bad employees working for you and you need to look at saying goodbye to some sour grapes.

@41 I see the point you're trying to make and do agree on one level but piracy is not theft. If a product is stolen the original owner then does not have a their copy. Piracy copies the product and nobody loses their copy. Yes the devs lose the profit they would have made if you had bought the product but nothing has been "stolen".

Personally I do not condone piracy in games. Music maybe as you can support that artist by going to their gigs or buying merchandise etc. But with games, you really should support your favourite dev.

@77: No offense, but I'm tired of that braindead conclusion. You're basically implying that everyone who pirates a game is a lost customer and would've otherwise bought the game if he had not have the opportunity to download the game.

Every pirater I know pirates for one reason - increasing disappointment of the gaming industry. And they only pirate because it's cheaper than renting.

Gamers with faith in the industry will always buy a game, it's not a question of "too expensive" or "pirating is cheaper". They buy it because they believe in the product.

I live in Argentina, and we have no support from Microsoft. I have to buy the console at 4 times its price, because our money exchange is 1 dollar= 4,35 pesos. Lots of people use the console modified because here a game cost $100 dollars = 435 pesos :(. They only play the campaign on games and do not use xbox live. At this moment I have no console She past away with the RRoD! Holy F...
