Brutal Legend
Activision sues Double Fine over Brutal Legend; EA and Tim Schafer Respond

Activision today filed suit against Brutal Legend developer Double Fine, claiming they put down $15 Million to see the game done, but Double Fine failed to come through, asking for more money (an additional $7 Million) and more time (another nine months).

During their merger with Blizzard (last July), Activision dropped Brutal Legend from their publishing resume. It sat in limbo for half a year before later being picked up by EA. Activision is now claiming they still have rights to Brutal Legend, and are aiming to halt the game's scheduled October 13th release.

In response to all this shady legal business, EA likened it to "a husband abandoning his family and then suing after his wife meets a better looking guy." Double Fine president Tim Schafer had this to say: "Hey, if Activision liked it, then they should have put a ring on it. Oh great, now Beyonce is going to sue me too."

@49 no, they shouldn't get their money back. thats how business works. companies spend lots of money on projects that never actually pan out- especially software companies. I'd even say so much as only 10-20% of software projects ever get finished. Should every company "get their money back"? of course not.

As for how this IP transitioned from Activision to EA, I'm not quite clear on. but Activision made an investment that didn't pan out for them, and they deserve nothing.

#57 Check your facts boss...Activision has published every single Call of Duty released to date. Call of Duty, CoD 2, 3 & 4 were developed by Infinity Ward. Developing and publishing are two completely different animals and can't be used interchangeably. #65 You need to check your facts first before telling others to do so. Activision publishes the CoD series. They didn't make any of them they just paid for them. I wonder if you even know what the difference between developer and publisher is even after pointing out they are different.

Infinity Ward did not develop CoD3, Treyarch did. This is because Activision is a company of greedy assholes that couldn't wait for Infinity Ward to make Modern Warfare, they wanted a new CoD NOW. That's how come we have CoD:WaW. Activision wants a new title EVERY YEAR (or in the case of GH 3-4 a year). That's also why Infinity Ward dropped their own CoD name; because Activision is beating it to death.

Thank you Omega Hunter, and yes captnlnsano I know they help "pay" for it but yeah all Publishers do it, its there job and that's it, and some other publisher would more then gladly pay for this game to finish as much as Activision, and Omega Hunter is right, they are greedy and milk franchises and are getting as bad as EA already, with Guitar Hero franchise, and Call Of Duty, I'm kinda glad they changed the name to Modern Warfare from now on. And anyway they get what they deserve for dropping titles they thought weren't "worthy" of their time and money.

I really hate Activison now... So what if they publish Call of Duty.. If they went bust a decent publisher would pick it up..

Activison only care about one thing and thats money.. Why do you think they joined Blizzard. Because they know Blizzard is getting Millions of $ every month from World of Warcraft. They dont give a shit about double fine wanting to make a decent game out of brutal legend, they just demand the game be finished on a certain date no matter how shit it is so they can make a quick buck. Look at Guitar Hero and Call of Duty for an example. Multiple games a year from the same franchise.

After the merger with Blizzard. Activision went at Venedi and put this game and a hand full of others on the chopping block because they couldn't see how to make a sequel of them every year.

It only makes sense to try the halt the production a huge game for your competitor. Activision and EA arguably publish every damn game out there. Activision has a case. Why not exercise your options to deal a huge blow to a rival?

Don't get me wrong, I want to play everything with Tim's name on it, but in terms of business...this is just a smart power play.

Broski's, no company is more money grubbing than Activision. They dropped this and ghostbusters because they "couldnt be exploited every year." Band HERO, Guitar HERO, DJ HERO?? Hell even Infinity Ward wants nothing to do with the Call of Duty name cause of them. EA is the lesser of 2 evils.

Anyway...Brutal Legend is gonna be a great game with great potential and Activision might aswell just admit they lost. It's like me investing 15m quid into a business, it don't work. Activision only really have GH and COD making them money. At least EA don't put out 7 iterations of the same fudging game each week. I used to like guitar hero but now activision are as bad as Fox with the Watchmen debarcle earlier this year. Still not seen a Fox film this year and other than Wolfenstein 3D I won't be getting any Activision titles for a long time.

unfortunately, i don't think this has anything to do with winning or losing the legal battle, but if it gets a fair hearing, brutal legend will get put back to the start of 2010, putting it out of the christmas run-in, letting GH5, DJ Hero and Band hero take over as must-haves for christmas

People have been slagging off EA for years, but have a good game track record of recent late (Dead Space, Fifa 09, Skate 2, ect.). However, for Activision, if it werent for Call of Duty people would wonder why they are still in this business.

The facts are this Actavision had a signed deal which terms were agreed apon. The fact is they already paid 15 million and from that the game was created. They then waited and it was delayed again and again and with no final product and an unfinished game they already dropped 15 million and it wasnt close to finished... so cut your losses as the legal contract has now been breeched (which they have deadlines to meet) and they were 100% right the develpoer is wrong. Now they dropped it and probably not too happy from the latest showing and Huge following which has grown alot. EA picked this up about 3/4 in and paid from the rest so it is what it is. EA has the means to cover the 15 million and its legally owed its petty but they are entitled to it. As far as EA is concerned they got a great

Activision suck. Not only are they pretty much symbolic of everything I dislike about this industry (and ironically things that EA used to be guilty of, though not to the extent of... Oh I don't know, 4 different Guitar Hero games in 12 months), but they dropped this project like a hot potato, among others. I for one was gutted, Schafers work is always of the utmost brilliance, then EA rescued it from the abyss. Suddenly Activision think it's still theirs? Tip guys... If you want a return on an investment, don't can it. Dick heads.

EA for the win baby, probably my favourite publisher of the last couple years, and picking up Brutal Legend just put the cherry on top of it :)

OK, so both companies are greedy as fuck. I really hope someday that small companies like Double Fine won't need larger companies for backing. A lot of smaller companies have fresh ideas and when they try to go to a larger company the ideas are squashed or changed. Screw both EA and Activision. Activision has totally become my least favorite game publisher/company. After their dropping a large handful of games because they didn't have the potential for "yearly installments" they go on and attempt to secure all the largest "franchises" (cod, wow, guitar hero). EA used to be the bad guys, but they've come away in my opinion by at least taking chances on new IPs.

I can't say I blame Activision trying to re-claim their 15 million $ investment. EA in my opinion, although probably legally ok, have been very immoral in how they handle their gaming. They take over, eat, and leave developers to die. Look at Origin, Bullfrog, etc. Just because this game ( Brutal Legend ) looks great, and is made by a great company and game maker (Tim)... EA will find any loophole they can and disregard any morals to justify getting this game out. Double Fine and Tim S. are just tagging along, because they couldn't finish the game without the extra investment ( its in their best and only interest), so Activision by all means should be able to reclaim their losses. EA isn't going to benefit them.
It may look like I am blasting the game and how its going, but I hate EA,

Not really. Harmonix completed production on all Guitar Hero games before they sold the entirety of the franchise to Activision. There is some dispute on who should pay for Brutal Legend, but there is absolutely no dispute on who should pay for Guitar Hero.

I'd like to add that the reason Activision's CEO gave for dropping all the titles that they did (Ghost Busters, Brutal Legend, etc) was that they "couldn't be exploited from year to year." That was his actual reason, he even used the term "exploited."

They kept total shit series like Crash Bandicoot, Spyro and Ice Age but dropped genuinely awesome looking games. And they did so because they couldn't milk them every year as per their MO. They didn't drop Brutal Legend because of delays and costs but rather because they didn't know how to push out a new one in a year and the following year then six months later. They don't deserve a dime back; EA's analogy is spot on.

I agree with you there, OmegaHunter. Apart from Crash Bandicoot being a shit series! I still play it on PS1 xD

The main reason they're not entitled to their money...is because they're not legally entitled to it.

They might think they deserve their money, but what self respecting game developer pumps 15m into an unknown game and then because of a few delays pulls out? None.

They invested their money in a business and risked 15m of it. The risk didn't work. They lose 15m and they get on with it. From sales of Cod4 and Cod5 alone i think theyre getting at least 50 times more so they should stop whining about their precious money.

They're only doing it so they get like 10% royalties from each game.

And EA aren't money grubbers. Do you think if they stopped selling games like Fif

You all seem to be having a go at Activision, but like someone else stated before me, they're making Modern Warfare 2, so if the money goes to that, i'm happy to wait another year for Brutal Legend. Also, EA have milked every series possible. And they have taken over loads of companies. To be honest though, Tim Schafer's come back was awesome. I don't like either company at all, Activision for milking the GH series dry, and EA because i've got a strong feeling that their the reason Criterion are now heavily overpricing their DLC, IMO.

Seriously, though, Activision is completely in the wrong here. The best comparison (besides EA and Shafer's) would be like that Ashton Kutcher-Cameron Diaz movie, were they get married, regret it, and split up, but then he makes a ton of money and because she wants that, she wants him.

What I find funny is that if you drop support for something...why the hell do you think you "deserve" the money when someone else finds a successful way to pull it off?

You put it behind you back, meaning you moved on. If they NOW decided to do something about it, that's a dick move on their part.

Activision did the same thing with DJ Hero and Scratch earlier in the year.

Most people are saying "screw activision" but if they had the mentality of "Oh, it's just a few million, we can take the loss" then they'd go bankrupt pretty soon. THey have the right to worry about losing $15 million. That's how you stay in business.

If EA/Double Fine is going to publish Brutal Legend with the $15 million Activision put into it, Activision deserves at least part of the sales money. Just because Activision refused to put $7 million more into it, doesn't mean the previous $15 million just disappeared. They have some stake in Brutal Legend.

This is actually a tough one. on the one hand activision has invested 15 million and they have nothing to show for it, and that was because Double Fine failed to provide. on the other theyre the ones who dropped it, and it doesnt look like theyd previously discussed any title rights with Double Fine

We all seem to agree that Activision is money hungry... and so is EA. Activision is stupid for suing a company that picked a game they didnt want. But someone in EA must have known that it would piss Activision off if they picked it up and made any sort of money off of it. Activision is releasing like 5 "hero" games this year. But EA has every sports game and 3 need for speeds, both companies own enough stock in the gaming industry that it doesnt matter who releases what they are still rolling in cash.

As for Brutal Legend.... it is gonna be the shit... if you like metal than you like Brutal Legend if nothing else it has the voiceovers and countless metal references. If you don't like it then you just dont understand the jokes and shouldnt be listening to metal in the first place.

For all the people screaming about "CoD Modern Warfare 2." Activision is not the developer, Infinity Ward is.

Activision is simply the "publisher" meaning they are the ones that make a cut on the game's profit by putting their company's stamp on the game basically. Activision is a publisher and all they do is oversee manufacturing and marketing of a game.

The Guitar Hero franchise [post GH2] has been done by Neversoft and various other pawn companies that Activision oversees.

So when you talk about "Activision making..." They don't make squat, they simply deal with advertising/marketing of the finalizes product. That is all.

I have to agree that Activision is in the wrong on this matter, they're just like every average money hungry joe. It's all about the money; even though the

If Activision wanted a piece of the Brutal Legend pie, then they should have worked that out with EA BEFORE they officially picked it up. They can't just discard it like yesterday's trash and then come back later after seeing all the hype and great press it's getting now and be like "Hey we're entitled to this!" Suck it up, move on and consider it a hard lesson learned, Activision!

Nahhh bud, that's GTAIV. Hey wait! Take 2 publishes it! Let's hate them!

How about we all ease off and realize that if there's two megapublishers in the end, then they'll release games appealing to pretty much every demographic (ie. more unique games) in order to reach a market that their opponent can't/hasn't?
Or the fact that many of these understaffed companies who release seriously lacking but well-written games (lolvalve) would benefit from having the extra staff and extra cash?
