Microsoft Will Start Banning Accounts for Using Offensive Language

Microsoft has announced that it will be rolling out its new Terms of Service in May for Xbox and more, which aims to clamp down on offensive language along with "fraudulent activity". Any accounts found to be breaking these new terms of service will result in having their account suspended.

The new Services Agreement reads, " In the Code of Conduct section, we’ve clarified that use of offensive language and fraudulent activity is prohibited. We’ve also clarified that violation of the Code of Conduct through Xbox Services may result in suspensions or bans from participation in Xbox Services, including forfeiture of content licenses, Xbox Gold Membership time, and Microsoft account balances associated with the account."

It looks as though Microsoft is trying to clamp down on any toxicity within the community by suspending accounts that would violate the offensive language rule. The only real issue with these changes is that it doesn't specify what words count as being offensive, so you may find that a friendly bit of harsh banter with a couple of friends could result in your account being suspended. Yikes.

Microsoft is yet to comment on the changes, not explicitly defining what constitutes as bad language, but let's hope that we won't be seeing a max exodus of account suspensions just because John called his friend Rob a little bitch in a friendly game of Rocket League.

  • So there's three ways this might be implemented, none of which are good: 1. This is policed by the community and based on the "Report Player" feature, which will lend itself to abuse and people being banned for no reason 2. It is based on text messages which are screened. Annoying, but easy enough to avoid. 3. It's based on voice chat which is being automatically monitored for trigger words. This is worrying because without a list of banned words, it's possible to get yourself banned for something you don't find offensive. "Cunt" is different for Australians than Americans, for example. Honestly, since the introduction of Party Chat on the 360, I've noticed far less toxicity online, since I usually can't hear other players. Yet Xbox has had the stigma of having a racist, offensive community since the Halo 2 days, and they're still trying to improve their reputation. I just hope this attempt doesn't wrongfully ban people.

  • I can see this tied to the rating as ok. Teen and below games that have proximity chat certainly would apply. My kids want to watch me play Sea of Thieves, for example. Its rated Teen and is cartoony pirate fun so its ok with me. However, the first player I encounter is likely to be yelling, "There's a guy. Kill the fucker!" So I have to always remember to go into the setting and Mute all other players as soon as I start. I shouldn't have to worry about M-rated language in a T-rated game. On the other hand, if you're playing an M-rated game, intended for players age 17+, you should be ready for that kind of language as long as it doesn't become a personal attack. I mean, you cant walk into a coffee shop and just yell "gimme some coffee, fuck face". But coffee shops don't have a "Rated M" sign on the door so...
  • Maybe I should boot Dead by Daylight and after one match, report all hate/offensice/vulgar messages that I got? Players over there are really worst in world. Overwatch or Rainbow Six: Siege is nothing to compare it. DbD is great game but I stopped playing because extreme toxic.

  • I got banned for telling people to go fuck themselves in my bio once, not sure how this change will make any difference. I'll be honest not sure they can ban you if your playing a game online and are offensive with your chat mostly because every game has the disclaimer that online play may affect it's rating i.e. it should be for adults only.

  • @20 this has never been a free speech issue. At no point throughout history has free speech ever extended into businesses. So nothing is changing. i suggest learning the law before claiming things are changing in any way. In fact, years ago it was illegal to use profanity in most public places. So if anything, free speech is more open now than it was years ago. OT: I don't have a problem with this. Maybe this way I can finally play a game without a 12 year old kid swearing at everyone else. It will teach these kids a hard lesson in life if they attempt to behave in a manner like that and then their account is banned. I don't understand why people think there is a difference between Xbox and normal life. At work when your boss gives you some crappy work, you don't turn to him and say "fuck you". A teacher doesn't walk into class and say "shut up you assholes and pay attention". At the office you don't come in and swear at your coworkers and call them derogatory names because they didn't do what you wanted. If you are in a private chat or message with only your friends. Then use whatever language you want. But in a public domain, you need to follow the rules and show some respect.

I'm very curious how they plan on countering troll reporters. Will evidence be required? If not, then this will go aide ways fast.
  • @26 Well said. I really don't take this as MS starting to scan every message or listen to every voice chat that is happening. I think it's A) meant to root out the worst of the people online, who think they have immunity to say terrible things and B) covering their asses when they ban/suspend accounts, as the attention this is drawing is essentially just highlighting a part of the ToS that most people would have skipped as they rush to the "accept" button on the last page of the ToS. I think it just boils down to a very simple fact. Don't be an asshole to strangers. Don't yell racist, sexist or homophobic things at anyone. That should go for all facets of life as well. If you ARE the type of person who feels the need to scream awful things at people & harass them, the faster you're banned, the better.

Now, do they check the message stream,or do they just take that persons word for it? This has got to be spelled out better. We all get upset and say things I am sure in the heat of a close game.

  • I would be surprised if this has anything to do with voice chat. I mean unless a moderator is in the lobby (maybe they play on adding lots of them) i don't think some employees will be monitoring and recording all the conversations happening on live. I think they will enforce more the text messenging report feature, wich is already enforce quite a lot. I really doubt any "algorythme" could automicaly ban you. I mean it would be ridiculous. The word "douche" in english is offensive and mean a ball sack, but in french it mean "shower" so it would be pretty stupid that this could get somebody banned. The word "Fuck" for an american is like a big cursing word. For us in french Quebec its an everybody word. I don't think you should be too worry about this.

  • I really don't like this idea, personally I usually don't swear much. Except when I play a game on it's highest difficulty setting, when I am at the end of a boss fight & screw up having to restart the boss fight. Nothing quite makes me feel better than yelling "Fuck". Maybe not the most mature thing to do but it helps me finish a lot of games. I don't wanna be banned for saying a swear word in a party.

  • As someone who does not communicate with anyone over Xbox Live in any fashion...this pisses me off. Because I do on PC games like League of Legends where I find it intolerable how much they take offense to behavior. My brother found my login and got me banned for 2 weeks and there was nothing I could do to reverse that and avoid the incoming permanent ban that put me in danger of. The main issue I had is the amount of cash I put into that game that could infinitely be lost. These restrictions and any like them are ridiculous.

Well... a short while later, I noticed my rep took a sharp nose-dive, as I got my first bad rep for language. I realized I shouldn't have said what I did, and I think it was someone on my own team (not on my friends list, though)... and I quit doing that, except in a private party where I know no one will say anything (and my friends know they can say anything to ME - even if it's to watch my language, and I'll abide). Xbox Live is NOT YOUR HOUSE! They have rules, and if you can't abide... get out! As for what's said in private messages, I would expect it's okay - unless the recipient reports you. Call Xbox Support for details, if you're that worried about it, but don't come here and threaten to leave Xbox... I say "good riddance," if you're that much of a baby and can't grow up!!

  • It's funny that Microsoft is willing to follow an authoritarian trend that is now successful rather than build on the "wild west" potential that had people flock to Xbox Live in the first place. In all honestly, it wouldn't be the same WITHOUT all the assholes, trolling, etc. and would see less incentive to stay. Then again we know this has more to do with pre/conditioning our behavior to suit their agendas more than it has to do with them actually being "compassionate" and giving a rat's ass about your "safety"
  • I think thats ok. In it's current state temporary bans are issued already. Permanent bans would be the only logical consequence if people are offensive repeatedly. The only "downside" with this is, you have to be really careful how to answer offenses in chat. You have to stay really really cool, or you can get a temporary ban as well.

It specifically states that it protects your right to say what you want and not be attacked by the government. That's the end of it. It doesn't protect you from private business, it doesn't protect you from Microsoft's ToS, it doesn't protect you from saying whatever you want at your job, etc. That's it! So when people whine that Microsoft is trying to attack their freedom of speech, I would suggest they spend less time on here, and more time doing their research. @72 & @73 are a perfect example of having no idea how things work.

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances." - Here is a basic example of the first amendment for you to read. Tell me where in there it mentions private businesses. "Obscenity is a category of speech unprotected by the First Amendment. Obscenity laws are concerned with prohibiting lewd, filthy, or disgusting words or pictures." - And just for added benefit I copied this from Cornell's Law School. I have a feeling they understand the law better than you.

My guess would be early teens? The ToS is a contract. You agreed to that contract when you signed up for Xbox Live. If you breach that contract, you forfeit everything. That's how the law works. Microsoft will get by just fine because there will never be a lawsuit against them for this reason. You know what, push the limit, get your account banned, sue Microsoft, and if you win, I would gladly cover the lawyer and court fees for you. I'm that confident that you will never win that lawsuit.

  • Totally agree with comment #38. This is just scary to me. Online gaming has always had the inclusion of curse words and I see this as just another barrier to keep you confined. If you play sports its about the banter the back and fourth crap talk. People need to take off the offended caps. Area mic's I feel are hardly even used any more and if you want to do any crap talk it is done via messaging. Who remembers playing XBL on the original Xbox games in game chat were not locked down ex. Halo 2, Splinter Cell Chaos Theory. Which allowed you to talk directly to the other team in live multiplayer game promoting lots of crap talk. I think its part of the culture.

  • @demon6666 bruh The first amendment literally says that Congress shall make no law prohibiting freedom of speech, among other things. It says nothing about the private workplace. The federal government can't stop it, but a private entity can remove you for it. LIVE is a private service, and MS can implement any rules they want. That is why Terms of Service exist, which you agree to. So go ahead and get your attorney, and he will explain that YOU are the one breaching the contract(ToS is a contract you agree to) and thus you are technically liable for whatever damages occur.
